Meeting Minutes

June 14, 2016

The regular business meeting of the Catawba Island Board of Township Trustees was called to order by Chairman William Rofkar on Tuesday, June 14, at 7:30 p.m. in the conference room.

In attendance were: William Rofkar, Gary Mortus, Matt Montowski, Karen Shaw, Dan Barlow, John Gangway, Ernie Wylie, Diane Belden, Josh Northrop, Glenda Ward, Richard Smetzer, and Randy Riedmaier.

The Pledge of Allegiance was recited by all.

Gary Mortus made a motion to approve the May 24 Board of Township Trustees regular meeting minutes as presented. Matt Montowski seconded the motion. All voted aye. Motion carried.

Matt Montowski made a motion to approve and pay the bills, including the last two payrolls, in the amount of $81,329.23. Gary Mortus seconded the motion. All voted aye. Motion carried.

Correspondence

A letter from the Ottawa County Engineer’s Office regarding various county railroad crossings scheduled for closure by Norfolk and Southern to make necessary repairs. All are scheduled to reopen by Friday, July 8.

Fiscal

Fiscal Officer Karen Shaw presented the May 2016 financial reports and bank reconciliation. There were no questions or concerns.

Fire and Safety

Fire Chief John Gangway said the recent ISO inspection went very well and took approximately three hours. He said they should know results in three or four weeks but there were no concerns at the time of the inspection.


Maintenance

Dan Barlow presented quotes for painting the Union Chapel on Porter Road and the old fire station on NW Catawba Road across from the Community Hall.

Union Chapel: Fox’s Painting $8,415, Madison Painters $10, 985, Prieur’s Painting $9,963, and Vision Professional Painting $10,650.

Old Fire Station: Fox’s Painting $3,825, Madison Painters $9,895, Prieur’s Painting $5,625, and Vision Professional Painting $4,680.

Gary Mortus made a motion to approve a contract with Fox’s Painting and Papering out of Fremont to prep and paint the Union Chapel and the old fire station per provided estimates for a total cost of $12,240. Matt Montowski seconded the motion. All voted aye. Motion carried.

Dan Barlow said Saturday, June 18, will be the last Saturday for loading mulch.

Matt Montowski confirmed with Dan Barlow that the maintenance department does not pick up grass clippings due to the damage it causes to the equipment. Grass clippings should not be left along the roadside.

Matt Montowski confirmed with Dan Barlow that the maintenance department picks up brush placed along the roadside every other week throughout the season and leaves in the fall. He said exact dates are not available as it depends on the weather and when the leaves fall.

Zoning

Glenda Ward asked why it was necessary for the township to hire legal counsel for the zoning inspector for the recent appeal of the zoning permit issued regarding Dollar General. Specifically, she asked why the township’s normal legal counsel, Ottawa County Prosecutor Mark Mulligan, could not serve as the zoning inspector’s legal counsel.

William Rofkar said Mark Mulligan is the township’s legal advisor but in this particular case since he would be offering advice to the Board of Zoning Appeals, Mark Mulligan said the township should get separate counsel for the zoning inspector because it was the zoning inspector’s decision that the BZA was reviewing and therefore a conflict of interest.

William Rofkar said the appeal of the zoning inspector’s decision to the BZA was a unique situation and since a decision has been made now Mark Mulligan will continue as legal counsel for the township. The Ottawa County Prosecutor provides legal counsel to townships within the county.

Matt Montowski said for the record the decision of the appeal was that since there were five parking spaces in the application for zoning certificate that do not comply with the zoning resolution, application #008651 should not have been granted. Said zoning certificate was revoked by the Board of Zoning Appeals Chairman Bryan Baugh.

Matt Montowski said there were thirteen zoning permits and three variances issued in May with a total of $1,378.98 collected in fees.


New Business

Gary Mortus made a motion to participate in the Ottawa County Engineer’s Road Striping Program for 2016 and stripe the roads as listed below. Matt Montowski seconded the motion. All voted aye. Motion carried.

Muggy Road beginning at State Route 53 (Stop bar at State Route 53)
Cemetery Road between County Road 30 and State Route 53 (Stop bar at both ends)
Schoolhouse Road between County Road 30 and State Route 53 (Stop bar at both ends)
Moores Dock Road between County Road 30 and State Route 53
Wine Cellar Road between County Road 30 and State Route 53 (Stop bar at both ends)

Gary Mortus made a motion to participate in the Ottawa County Engineer’s Road Resurfacing Program for 2016 and resurface Konker Road and Wine Cellar Road. Matt Montowski seconded the motion. All voted aye. Motion carried.

Gary Mortus said he will set up a meeting with Dan Barlow and the county engineer to meet with Gem Beach property owners regarding the sea wall on Basin Road to help determine the next course of action to be taken.

Matt Montowski made a motion to renew with Hylant Administrative Services and Ohio Plan Risk Management, Inc. for township property and liability insurance for the year June 15, 2016 through June 15, 2017 in the amount of $44,445. Gary Mortus seconded the motion. All voted aye. Motion carried.

Gary Mortus made a motion to adjourn the meeting. Matt Montowski seconded the motion. All voted aye. The meeting adjourned at 8:10 p.m.
