ZONING COMMISSION MINUTES

Members of the Commission in attendance were Chairperson Jordan Davenport, Paul Shaw, Ron Wiseman, Lewis Mindlin, and Secretary Todd Bickley. Trustee Matt Montowski was also in attendance.

The Pledge of Allegiance was recited.

Chairperson Davenport called the meeting of the Catawba Island Township Zoning Commission to order at 7:00 p.m. For the record, he identified the date as September 23, 2020. Chairperson Davenport requested that all cell phones be silenced, remove yourself from the meeting if you must take a call, sign the attendance sheet, wait to be recognized by the chair before speaking and to identify yourself by name and address, and do not debate amongst yourselves.
Chairperson Davenport reviewed the agenda.
Agenda Item 1 – Request for a Zoning Amendment
Chairperson Davenport referenced Application #254894 which is a rezoning request to rezone property located at Lot 55 of Gem Beach Subdivision 1 from the “A” Residential Low Density District to the “R-6” Residential District. Chairperson Davenport read the letter from the Ottawa Regional Planning Commission which recommended approval of the rezoning request.
Chairperson Davenport recognized Jerilyn Royle. Mrs. Royle noted that the current structure is a single family dwelling. Jerilyn indicated that Roger & Dale Spencer (father and uncle) are both deceased and the Trust has transferred to her brothers and herself. The plan is to tear down the single family home and build a two family dwelling.
Secretary Bickley commented that he met with Jerilyn and a brother at the property. Secretary Bickley advised the applicants that for a two family dwelling to be built, the lot would need to be rezoned to a district that allows a two family dwelling or apply for a use variance. Secretary Bickley noted that a use variance is usually the last option to be used. Thus, the applicants elected to proceed with a rezoning application to the “R-6” Residential District.
Lewis Midlin questioned if the structure will be a duplex. Mrs. Royle indicated that the structure will be a duplex, up and down. Mr. Midlin questioned the size. Mrs. Royle stated that the size will be between 2,400 – 2,800 square feet.
Ron Wiseman questioned if the house will need to be elevated. Mrs. Royle commented that the lot is closest to the beach, but was not sure if the structure will need to be elevated. Secretary Bickley noted that the area is in a floodplain and that the Ottawa County Building Department will require the home to be at or above the 100 year floodplain. The existing elevation as it relates to the 100 year floodplain level will determine the amount of elevation required.
Chairperson Davenport questioned whether an issue exists since the applicants own the adjacent lot. Secretary Bickley indicated that Lot 55 is considered a separate lot with a single family dwelling. The adjacent lot has a separate structure and is considered a separate lot. Secretary Bickley did note that the ownership as listed by the Ottawa County Auditor’s office should be corrected to show that Jerilyn and her two brothers are now the property owners.
With no further discussion, Ron Wiseman made a motion to recommend to the Trustees approval of the Case #254894. The motion was seconded by Paul Shaw. A voice vote resulted as follows:
Ron Wiseman – yes, Lewis Mindlin – yes, Paul Shaw – yes
The motion passed.
Agenda Item 2 – Approval of Minutes
With no corrections, Chairperson Davenport commented that the August 26, 2020 Meeting Minutes are approved as emailed.
Agenda Item 3 – Unfinished Business
Chairperson Davenport informed the Zoning Commission that the text amendments were approved by the Trustees. Secretary Bickley indicated that text amendments will be effective October 22, 2020.
Agenda Item 4 – New Business
No new business.
The next meeting of the Catawba Island Zoning Commission is Wednesday, October 28, 2020 at 7:00 p.m.
